New US Bankruptcy Rules:  They Effect YOU!

The firm’s practice of bankruptcy law includes the following areas:

David Hillier is a North Carolina Legal Specialist in Bankruptcy Law.  He has been a consumer bankruptcy attorney for more than 30 years.  He and his staff understand the practical and emotional impact that financial distress can cause.  Dave is prepared to educate you about your options and how the law applies to your individual circumstance.  While Dave believes that understanding is a large part of alleviating the stress that bankruptcy can cause, he discourages clients from reading too much on the internet or participating in deep research.  It has been a growing concern that much of what is available on the internet is out of date, incorrect or inapplicable, and clients worry themselves over information that may not apply to their individual circumstances.  To help with this, we have created some common sense documentation in the bankruptcy section of this website.  We encourage you to use it, but want to assure you that we will make every endeavor to see that you completely understand where you are, what a healthy financial perspective can create, and how to navigate the space between those two points.  Your plan will be tailored to your specific circumstances without the additional stress of random bankruptcy rules clouding your thoughts and financial goals. 

Dave approaches a person's financial situation in much the same way a doctor might conduct a physical examination.  The more information you are able to provide about your situation, the better the diagnosis and more sound the course of treatment.  We have created an online questionnaire that will help you organize your financial thoughts and help us create a history upon which your financial position can be restructured.  Even with the increase in consumer bankruptcy filings in the past few years, a percentage of Dave's practice is centered on what he calls "financial distress".   Dave can suggest strategies and assist individuals and businesses in connection with their financial situation outside of bankruptcy.  No matter your needs, your one hour initial consultation is cost and risk-free.

Mr. Hillier has served as a Chapter 7 Panel Trustee for the United States Bankruptcy Court for the Western District of North Carolina since the late 1970’s, a period in excess of thirty years.  Duties of the Chapter 7 Trustee include reviewing petitions and liquidating assets for the benefit of creditors.  Acting as Chapter 7 Panel Trustee is an honor and a position of some prestige.  Dave is presiding officer at initial hearings in Chapter 7 Bankruptcy cases.
